‍Deposit & Confirmation Process

‍We require a deposit of $500 to initiate the order process. Once we receive the deposit, we will contact you to confirm all the order details to make sure that everything is in order before we finalize your order and start creating your pump track. This deposit is refundable if during the confirmation process we determine that you no longer can complete the purchase due any conflict with this purchase policy.

‍Modular Pumptrack USA - Modular Pump Track Purchase and Warranty Sheet:

This Term Sheet ("Agreement") sets forth the terms and conditions for the purchase of a modular pump track ("Product") from Modular Pumptrack USA ("Seller") by the undersigned customer ("Buyer"). Please carefully review and acknowledge the terms outlined below:

‍(1) Communication and Updates:

Seller commits to maintaining open and transparent communication with the Buyer throughout the order process. Timely updates will be provided regarding the production status, shipping readiness, and the expected delivery date and time of the modular pump track.

‍(2) 5-Year Warranty:

Seller offers a 5-year limited warranty ("Warranty") covering structural failure of the modular pump track resulting from natural deterioration.

‍(3) Exclusions:

Minor chips, hairline cracks, or efflorescence resulting from normal wear and tear are not covered under this warranty. Deterioration due to the corrosive environment near a saltwater coast are considered normal wear.

‍(4) Additional Terms:

For modular pump tracks located within 500 yards (457 meters) of a saltwater shoreline, the warranty coverage duration is reduced to two and a half years from the date of purchase.

(5) Non-Transferable:

This warranty applies exclusively to the original purchaser of the modular pump track and is non-transferable.

‍(6) Claim Procedure:

To file a warranty claim, the purchaser must provide proof of purchase and notify the manufacturer within the warranty period. Follow these steps to make a warranty claim:- Contact Modular Pumptrack USA.- Submit required proof of purchase and relevant information.- The manufacturer will assess the claim's eligibility under the warranty coverage.

‍(7) Limitations:

This warranty is restricted to the repair or replacement of the defective modular pump track, at the manufacturer's discretion. Additional expenses related to replacement, including shipping, labor, or installation fees, are not covered by this warranty. Damage or failure resulting from improper installation, misuse, abuse, accidents, or acts of nature is not covered under this warranty.

‍Release of Liability:

Buyer acknowledges and agrees that the use of the modular pump track ("Product") involves inherent risks, including but not limited to the risk of bodily injury, harm, or damage. In consideration of the purchase and use of the Product, Buyer, on behalf of themselves and their successors, assigns, heirs, and personal representatives, hereby releases, discharges, and holds harmless Modular Pumptrack USA ("Seller"), its affiliates, agents, employees, officers, directors, and contractors (collectively referred to as "Released Parties") from any and all claims, demands, actions, liabilities, costs, expenses, or damages, whether at law or in equity, arising out of or in connection with the use of the Product.

Buyer further agrees to indemnify and hold the Released Parties harmless against any claims brought by third parties arising from or related to the use of the Product. This release and indemnity include, but are not limited to, claims arising from negligence, premises liability, or any other theory of liability, whether caused by the actions or omissions of Buyer, other riders, or third parties.

By clicking "I Understand" below, Buyer acknowledges and agrees to the terms and conditions outlined in this Agreement, including the Warranty and Release of Liability sections. This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, oral or written. Any modifications to this Agreement must be made in writing and signed by both parties.
